Prah Sands - A Tuck's card

I can't make out the post mark. The reference to a gas mask in the text suggests it is from no earlier than late 1930s and it is addressed to my granmother at the house she moved out of during 1940. So the picture must be around sixty years old if not more.
If there is a Copyright notice in the image, should it be displayed before checking? I know this is a minefield, but better than being sued!!

Because of lack of donations at this time, Picture Penzance seems to be surviving from day to day on the goodwill and financial input of the owners and some members. Should a surviving member of any of the old image holders decide to sue PPz, who is going to pay for that case??? DONATE FOLKS!!!!!!!!!!!!!!!!!!!!

The term copyright on a card does not necessarily mean that it is still in operation; there are many factors to be taken into account; certainly cards prior to 1939 are ones to be considered and checked; Ones after that date are ones that will be considered and checked first; we are currently active in checking companies concerned. There are a number of factors to be taken into account before a case can be assembled for action on the part of an interested party on behalf of any alleged owner of Intellectual Rights. A guideline will be published here before long - I am more concerned over any appearance of registered trademarks.

Seems a strange cut off date, look forward to clarification of this?
 
The rule is based on the limit of 70 years for copyright to be held (under certain other conditions) after either the photographer s death or the date of the photograph; there are many circumstances which are involved, and it takes a long tome for anything to happen - the first of which is for the alleged intellectual property owner to ask for its removal from the site; a bomb is just not suddenly dropped; I have been in contact with two men with considerable experience in such matters, and it is extrememly onerous to sort these matters out before any court proceedings occur. 1939 is a point at which there would be almost certainly a case to be thoroughly investigated - but one problem is in tracing, for example, any family or business that has any alleged claim.
The situation is less problemmatical that it appears - the Laws were written to protect current owners in our digital age and, as I say, there are basic mandates that have to be saitisfied to ensure any claimant is fully prepared before entering any legal claim, otherwise the case is dropped immediately by that court. In short it is a long process, in which certain conditions may be met with amicable results, not including intense fines or claims.
